Rights Granted to National Braille Press by Entry
Submission of an entry grants National Braille Press (NBP) the right to use, publish, adapt, assign, edit, dispose of, and/or modify the submitted name(s) in any way, in commerce and in any and all media worldwide, without limitation or compensation to the entrant, and entrant would be required to sign a release to that effect. Submission of an entry further constitutes the entrant's consent to irrevocably assign and transfer to NBP any and all rights, title and interest in and to the proposed name, including but not limited to all intellectual property rights therein. The winning name may be used, at the sole discretion of NBP, as the official name of the product, but NBP is under no obligation to use the winning name in this or any other way. By entering, entrants acknowledge compliance with these Official Rules, including all eligibility requirements. Entrants hereby releases NBP and all of their respective employees, directors, officers, agents, successors and assigns (collectively "Releasees"), from any claims, losses, actions, or damages, whether actual, incidental or consequential, arising out of or relating to entrant's participation in this Contest.
Winner(s) grant NBP the right to use his/her/their name, likeness and biographical information for advertising, publicity, promotional and other purposes in commerce and in any media worldwide without limitation or additional compensation, unless prohibited by law.
Winner Select
In the event that any one of the winning names has been submitted by multiple entrants, NBP will select the entrant with the earliest posting timestamp, and that entrant shall be the winner. All other entrants who submitted said name shall not be entitled to any prize. If the winner(s) is under the age of 18, said person's parent or legal guardian will be required to sign a release.
Prize
The Winner will receive a National Braille Press gift bag and have the satisfaction of knowing that he/she has played a role in helping to bring literacy to blind people.
Announcement of Naming Contest Winner
Winner(s) will be announced on Facebook by Monday, May 31, 2010. An announcement about the winner(s) will also be posted on the NBP website and will be included/publicized in one e-newsletter produced by NBP.
NBP reserves the right, in their sole discretion, to cancel or suspend this Contest should virus, bugs, fraud or other causes beyond the control of NBP corrupt the administration, security or proper play of the Contest and in such case to award the prize from among eligible entries received as of the date of cancellation/suspension.
CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, NBP RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
NBP assumes no responsibility for the following: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by NBP or its agents for any reason; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries; (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants' or any person's computer and/or its contents, or causes beyond NBP's reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest; (iv) any entries submitted in a manner that is not expressly allowed under these rules; all such entries will be disqualified; or (v) printing errors in these Official Rules or in any advertisements or correspondence in connection with this Contest.
